Basic Licence (Free of charge)

The Basic Licence covers usage of the images. Unfortunately this is what we have to do to protect ourselves against those who choose not to do the right thing and/or refuse to take responsibility for their own actions.

1) Andrew Furlong Photography Pty Ltd provides the images 'as is' without any warranty of any kind as to the suitability of the images for the licensees intended purpose.
2) All risk as to the performance of the images and its contents are the sole responsibility of you, the licensee.
3) Andrew Furlong Photography Pty Ltd makes no guarantees as to the suitability of the images for use by you and any subsequent alterations. Examples of such alterations, but not limited to, are: conversion from RGB to CMYK, production of colour separations incorporating any of the contents of the images, re-sizing of the images or alteration of resolution, colour balance, contrast, saturation or any other manipulation, copying of the contents of the software to any internal/external hard drive or other type of permanent or removable storage media.
4) The licensee is licensed to use the images in any printed advertising or promotional material, corporate documents such as Annual Reports, brochures, trade show presentations, logos, newsletters and multi media packages, Television/Cable advertising, web page design/advertising and other electronic presentation media such as cd-rom.
5) The licensee is not entitled to use the images for, or in any item or product for sale without upgrading this licence with Andrew Furlong Photography Pty Ltd. Examples of such items but not limited to, are; postcards for sale, calenders, t-shirts, books, greeting cards, phone cards, CD/Album Covers and inserts, multimedia games and products for sale.
6) Andrew Furlong Photography Pty Ltd is not aware that the images infringe any known trademark or otherwise protected intellectual property of any other individual or organisation, but does not guarantee that this is the case, therefore the licensee is responsible for ensuring their use of the image does not infringe any trademark or otherwise protected intellectual property of any other individual or organisation.
7) The licensee is not entitled to sell, market, distribute, duplicate or grant rights to the images to any other third party, and products or material produced by the licensee containing the images shall in no way indicate or grant rights to use or duplicate the images either individually or collectively.
8) The images may not be used in any way which could be deemed to be pornographic, defamatory, libellous or unlawful.
9) The licensee agrees, by use of the images, to indemnify Andrew Furlong Photography Pty Ltd against any and all actions taken against either the licensee and or Andrew Furlong Photography Pty Ltd.
11) The licensee accepts and acknowledges that Andrew Furlong Photography Pty Ltd owns and retains all copyright to the images and that this licence agreement does not constitute a transfer of copyright to the licensee.
11) The licensee agrees that any breaches of this agreement by the licensee will entitle Andrew Furlong Photography Pty Ltd to recover from the licensee damages for, but not limited to, any loss of sales, profits or goodwill caused by the licensee’s failure to comply with this agreement.

Upgrade Licence

This licence is essentially the same as the Basic licence but also allows the licensee to use the images in items or products for sale ie books calenders, CDs etc.

1) Andrew Furlong Photography Pty Ltd provides the software 'as is' without any warranty of any kind as to the suitability of the contents for the licensees intended purpose.
2) All risk as to the performance of the software and its contents are the sole responsibility of you, the licensee. Andrew Furlong Photography Pty Ltd makes no guarantees as to the suitability of the software for use by you and any subsequent alterations.
